EVOLUCIÓN/EXTINCIÓN

La vida evoluciona, las especies evolucionan, el hombre evoluciona, sus creaciones -las normas- evolucionan y se extinguen. Los marcos normativos pretenden conducir comportamientos humanos, establecen reglas que deben ser seguidos por los inversionistas mineras y congelan un estadio de una actividad o del conocimiento hasta el próximo cambio.

EL REY HA MUERTO, EL HEREDERO ESTA POR NACER

Han pasado 21 años, desde que se expidió el primer marco legal sectorial para regular las obligaciones ambientales para el desarrollo de actividades mineras, Decreto Supremo N° 016-93-EM. Dos fueron las instituciones reguladas, los Estudios de Impacto Ambiental -EIA- para las nuevas actividades de explotación y beneficio que se realizaran a partir de su entrada en vigencia y Los Programas de Adecuación Medio Ambiental -PAMA- para las operaciones mineras en curso al años 1993.

Para los iniciados, esta norma es la piedra angular de la aplicación del Código del Medio Ambiente, aprobado en 1990, fue minería quién dio el primer paso.Mucho trecho ha recorrido la industria minera desde ese entonces. Si el desarrollo económico del Perú, se sustenta en la minería, dicha norma introdujo la variable ambiental a la actividad, que fue posteriormente ampliándose con los Límites Máximos Permisibles, la Participación Ciudadana, los Estándares de Calidad de Ambiental, los Planes de Cierre, Remediación de Pasivos, Planes Integrales, Informes Técnicos Sustentatorios, Guías y Protocolos que abordaban temas medioambientales y sociales.

Muchos proyectos mineros, pequeños, medianos y grandes se han convertido en operaciones mineras y han contribuido al desarrollo económico del país, la institucionalidad estatal ha evolucionado también, la creación de las direcciones ambientales, las fiscalizaciones ambientales por los sectores, dieron paso al OSINERGMIN y luego al OEFA y ahora al SUNAFIL, seguridad en las operaciones, salud laboral, la gestión ambiental, el SINEFA, el SEIA y el SENACE. los tiempos cambian las normas cambian.
